Erica Herman filed a court petition to have a non-disclosure agreement she signed when they initially started dating in 2017 revoked. She highlighted a statute that makes NDAs invalid in cases of sexual assault.

Court records from the lawsuit she filed shortly after their breakup in October have surfaced, and PEOPLE obtained them on Wednesday.

In the brief, the defendant Jupiter Island Irrevocable Homestead Trust requests that Herman’s lawsuit be considered by an arbitrator. In her allegations, Herman claims she had an oral arrangement with the trust that permitted her to stay at Woods’ house for another five years.

Lawyers for the trust say that Herman was only permitted to live in the house while courting Woods. The 47-year-old sportsman presently resides on the estate with his two daughters, whom he shares with ex-wife Elin Nordegren. Herman was told she needed to move out after Woods ended their relationship in October.

“Ms. Herman responded to the breakup by filing this lawsuit,” the attorneys stated. Herman alleges she is entitled $30 million for breaching the oral agreement when the trust’s staff “locked her out of the Residence, removed her personal belongings, and informed her she could not return.” Herman also claimed that she had more than $40,000 in cash that was “misappropriated.”

According to court records, Herman is seeking consequential monetary damages, injunctive relief, and attorney’s costs under the Florida Residential Landlord Tenant Act.

The trust’s lawyers note that under the NDA, which was attached to the lawsuit, Herman “is required” to resolve any disputes she has with Woods through confidential arbitration. But by suing the trust rather than Woods, Herman hopes to litigate the charges in a “public forum.”

Woods wants the claims examined by an arbitrator, who he thinks will find that Herman never had an oral agreement over the residence and that she is not owed any damages.

The trust’s attorneys have filed a motion to suspend proceedings until the arbitration dispute is resolved. They supplied a redacted version of the NDA, which stated that any disputes between Herman and Woods must be resolved through arbitration. The now-exes both signed the deal on August 9, 2017.

PEOPLE contacted Herman’s attorneys but did not receive an immediate response.Herman asserts in her own complaint that the NDA should be void, citing the Speak Out Act, which protects sexual assault and harassment victims.

According to the records, Woods and Herman “had a long relationship” that was professional and personal. Herman alleges she is “currently unsure what other information about her own life she may discuss or with whom,” according to the complaint.

According to the story, Herman has not made any complaints against Woods.

Herman, a former restaurant manager, was first romantically linked to Woods after she was photographed with him at the Presidents Cup in New Jersey in September 2017. Herman wore a badge meant for players’ girlfriends and spouses throughout the competition, where Woods served as assistant captain for the United States team.

Herman has been a consistent presence on the course anytime Woods competes. However, the couple has stayed fairly quiet over the years (a stark contrast to Woods’ former relationship with Lindsey Vonn and his very public marriage and divorce from Nordegren).

They were rarely seen in public at non-golf events, but they did attend the 2022 US Open together to cheer on Serena Williams from the stands. Herman does not have a social media presence and has only appeared three times on Woods’ Instagram account since October 2017.
